Marital Property Regimes

The default property regime for marriages after August 3, 1988 is Absolute Community of Property (ACP), where all property acquired during the marriage is jointly owned. Under ACP, the surviving spouse owns half of the community property outright — only the other half forms part of the estate. Couples who signed a prenuptial agreement may have Conjugal Partnership of Gains (CPG) or Complete Separation of Property. Under CPG, only profits and gains during marriage are shared. Under Separation, each spouse owns their property entirely.
