Terms of Service

1. Acceptance of Terms
By creating an account, making a payment, or using any Pamana.ph service, you agree to be bound by these Terms of Service. This constitutes a valid electronic agreement under Republic Act No. 8792 (Electronic Commerce Act of 2000). If you do not agree to these terms, do not use our services.
2. Eligibility
You must be at least 18 years old to use Pamana.ph, consistent with the age of majority under Republic Act No. 6809 and the minimum age for making a will under Philippine Civil Code Article 797. By using our services, you represent that you have the legal capacity to enter into a binding agreement.
3. Description of Service
Pamana.ph is an online platform that provides self-help document preparation tools for estate planning. Our services include: a guided questionnaire to gather your estate planning information; automatic computation of compulsory heir shares (legitime) based on Philippine Civil Code Articles 886–909; generation of formatted will documents (notarial and holographic); PDF download with a signing ceremony guide; and educational content about Philippine succession law.
4. Not a Law Firm — No Legal Advice
Pamana.ph is NOT a law firm and does not provide legal advice, legal opinions, or legal recommendations. We provide self-help document preparation tools based on your inputs and the provisions of the Philippine Civil Code. No attorney-client relationship is created between you and Pamana.ph. Information you provide to Pamana.ph is NOT protected by attorney-client privilege. Our platform does not review your inputs for legal sufficiency, and does not draw legal conclusions about your specific situation. For complex estates, contested wills, blended families, foreign property, or any questions about your legal rights, we strongly recommend consulting a licensed Philippine attorney.
5. Will Validity and Execution
A will document generated by Pamana.ph is NOT legally valid until it has been properly signed and executed in accordance with Philippine law. For notarial wills: the testator and at least three credible witnesses must sign every page, and the will must be notarized by a duly commissioned notary public (Civil Code Articles 804–806). For holographic wills: the testator must write the entire will entirely by hand, date it, and sign it (Civil Code Article 810). Pamana.ph is not responsible for ensuring that you complete these execution formalities. Our signing ceremony guide is provided for informational purposes only.
6. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating your account and filling out the questionnaire. You must promptly notify us of any unauthorized access to your account.
7. Accuracy of Information
The accuracy of your will document depends entirely on the information you provide. Pamana.ph does not independently verify the accuracy or completeness of your inputs. You are solely responsible for ensuring that the information you enter — including family members, property details, beneficiaries, and wishes — is accurate and up to date. Errors in your inputs will result in errors in your generated document.
8. Pricing and Payment
Pamana Complete costs ₱1,100 (one-time payment per will). An Update Pass costs ₱200 for 365 days of unlimited updates. Payments are processed by PayMongo through GCash, Maya, or credit/debit card. All prices are in Philippine Pesos and include applicable taxes. Prices may change, but changes will not affect existing purchases.
9. Refund Policy
If you have not yet generated your will document, you may request a full refund within 7 days of payment by contacting [email protected]. Once a will document has been generated and made available for download, refunds are not available because the digital service has been fully delivered. If we fail to generate your document due to a platform error, you are entitled to either a corrected document or a full refund at your choice, consistent with Republic Act No. 7394 (Consumer Act). Refunds are processed through the original payment method within 15 business days.
10. Intellectual Property
The Pamana.ph platform, including its software, design, legal computation engine, document templates, and educational content, is owned by Pamana.ph and protected under Republic Act No. 8293 (Intellectual Property Code). You own the content of your generated will documents. You may not copy, modify, distribute, reverse-engineer, or create derivative works from our platform, templates, or engine.
11. Disclaimer of Warranties
Pamana.ph provides its services on an "as-is" and "as-available" basis. While we strive for accuracy in our legitime computations and document formatting, we do not warrant that: our services will be uninterrupted or error-free; generated documents will be accepted by any court, notary, or government agency; our legitime calculations are suitable for every possible family situation; or our educational content is complete or current. These disclaimers do not affect your rights under the Consumer Act (RA 7394) or other mandatory Philippine consumer protection laws.
12. Limitation of Liability
To the maximum extent permitted by Philippine law, Pamana.ph's total liability for any claim arising from your use of our services shall not exceed the total amount you have paid to Pamana.ph. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of inheritance, estate disputes, tax consequences, or legal fees arising from the use or inability to use our services. Nothing in these terms excludes liability for fraud, gross negligence, or willful misconduct.
13. Indemnification
You agree to indemnify and hold harmless Pamana.ph, its officers, and employees from any claims, damages, or expenses arising from: your use of our services; your breach of these terms; inaccurate information you provided; or your failure to properly execute your will according to Philippine law.
14. Dispute Resolution
If you have a dispute regarding our services, you must first contact us at [email protected]. We will attempt to resolve your concern within 7 calendar days through our internal dispute resolution process, as required by Republic Act No. 11967 (Internet Transactions Act). If the dispute is not resolved through this process, either party may pursue remedies through the courts.
15. Governing Law and Venue
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms or your use of our services shall be resolved exclusively in the appropriate courts of Metro Manila, to the exclusion of all other courts.
16. Force Majeure
Pamana.ph shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet or infrastructure failures, or acts of third parties, consistent with Civil Code Article 1174.
17. Termination
You may close your account at any time through your account settings. Pamana.ph may suspend or terminate your account if you violate these terms, provide fraudulent information, or use our services for unlawful purposes. Upon termination, you may export your data as provided in our Privacy Policy. Generated documents will remain accessible for 30 days after termination.
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated terms on our website with a new effective date. Your continued use of our services after the effective date constitutes acceptance of the updated terms.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pamana.ph regarding the use of our services.
